I haven't seen the episode yet, although the HUTH was good :sljo:

In D&C have a power to search if requested by or assisting a PC. Is this not nationwide?

I don't know where you get that power from Minx, I too am a PCSO with D&C Police and have been for 10 years, I can assure you D&C PCSO's do not have a power to search, other than outer clothing of a person who you see conceal Alcohol in a Designated Area, and Juvenilles with Tobacco Products.

PCSO's are NOT permitted to Search a Person if Requested or Assisting a PC, this would be an Unlawful Search, SO DON'T DO IT !!!

I think a lot of PCSOs believe if told to do something by a PC it makes it legal :slroll:

AndrewB, comments like that may seem appropriate to you but I doubt they do to most here.
You and my esteemed force mate Tonker should possibly reread PACE sec A Annex C (and not make assumptions). :slluvv:

Minx, as in my previous post you may search outer garments in a designated area for alcohol containers etc... or tobbaco products on juviniles etc, if you come across drugs during those searches then you can seize those drugs and pass them onto a PC when they arrive.

D&C PCSO's DO NOT HAVE THE BELOW POWER:
Police Reform Act 2002, Schedule 4, paragraph 2A Objects that might be used to cause physical injury to the person or the CSO.

EXACTLY, no PCSO in the UK has the power to search unless, as stated in PACE power to search for articles that can be used to harm or assist in escape, but that has to be designated from ur CC as it is not a standard power however, if your on your own in the sticks and no back up for a while then go figure.
Obviously if you have the power to search for fags and drink as per the policy, if you find something whilst lawfully searching for alcohol and fags then you can seize it, but you cant search the person, only bags and outer coat. stupid i know bu the law is an ass.

Im actually a PCSO and im stating a fact. I've seen pcsos before step out the remit because a PC has asked them to do something, because 5 years ago what we can or cant do was common knowledge...


Also a search im custody sec 54 pace...if you read the wording it states "constable" and "custody officer" but im sure DDO would fit in this remit...nothing about PCSOs.

PCSO's do not have the power to search a person under S54 PACE 1984. That is for constables, suitably designated DDO's and Escort Officers.

Another way things differ. In the Met, a Response Car/Van is referred to as a "unit"!
